Flertallet mente at man stod overfor et erstatningskrav der de vanlige vilk\u00e5rene for erstatning, blant annet \u00f8konomisk tap, m\u00e5tte gjelde s\u00e5 langt ikke annet fremgikk av loven.<\/p>\n<p dir=\"LTR\">Mindretallet mente at utleiers krav p\u00e5 dekning av n\u00f8dvendige utgifter til utbedring av mangler ikke er et erstatningskrav, og at slike utgifter derfor kan kreves dekket selv om utleier ikke er p\u00e5f\u00f8rt \u00f8konomisk tap ved misligholdet, men at det m\u00e5tte gj\u00f8res unntak n\u00e5r utbedring ikke hadde noe fornuftig form\u00e5l \u2013 slik tilfellet var i denne saken.<\/p>\n<p dir=\"LTR\">Source: <a
