Etter overtakelse engasjerte kj\u00f8perne en sakkyndig, som oppdaget museskader og feil ved boligens kledning og garasjeveggene.<\/p>\n<p>Kj\u00f8perne krevde heving av kj\u00f8pet. De fikk medhold i tingretten, men ikke i lagmannsretten. Siden kj\u00f8perne hadde f\u00e5tt opplysninger som ga grunn til bekymring, var det etter lagmannsrettens syn rimelig \u00e5 kreve at de unders\u00f8kte boligen n\u00e6rmere eller tok forbehold ved kj\u00f8pet.<\/p>\n<p>H\u00f8yesterett kom til at det ikke var grunnlag for \u00e5 avskj\u00e6re mangelskravene av den grunn at kj\u00f8perne ikke hadde unders\u00f8kt boligen tilstrekkelig. Selv om kj\u00f8perne visste at det hadde v\u00e6rt mus i boligen, og at det var gjort ufagl\u00e6rt arbeid, var de ikke kjent med at dette hadde f\u00f8rt til skader. Etter H\u00f8yesteretts mening kunne slike generelle risikoopplysninger ikke i seg selv utl\u00f8se en plikt til s\u00e6rlige unders\u00f8kelser, med den f\u00f8lge at kj\u00f8peren overtar risikoen for skjulte feil og mangler. Noe annet ville \u00e5pne for omg\u00e5else av den risikoplasseringen som Stortinget la opp til ved endringen av avhendingsloven \u00a7 3-9 i 2022, som fjernet adgangen til \u00e5 selge en bolig \u00absom den er\u00bb til forbrukere. Det var ingen ytre tegn til skader p\u00e5 boligen som kj\u00f8perne burde ha oppdaget ved den ordin\u00e6re visningen.<\/p>\n<p>Lagmannsrettens dom ble dermed opphevet.
