I 2014 mente kommunen at byggetillatelsen hadde falt bort etter plan- og bygningsloven 1985 \u00a7 96, fordi det kun var utf\u00f8rt grunnarbeider p\u00e5 tomten, og fordi arbeidet var innstilt. Kommunen ga p\u00e5legg om \u00e5 tilbakef\u00f8re tomten til opprinnelig tilstand.<\/p>\n<p>Da husbyggeren ikke etterkom p\u00e5legget, ila kommunen ham tvangsmulkt. Husbyggeren betalte ikke mulkten. Da kommunen \u00f8nsket \u00e5 tvangsfullbyrde mulkten, anla han s\u00f8ksm\u00e5l om gyldigheten av den.<\/p>\n<p>For domstolene var sp\u00f8rsm\u00e5let om fremdriften i byggearbeidene var tilstrekkelig til \u00e5 hindre bortfall av tillatelsen. I s\u00e5 fall var kommunens p\u00e5legg og tvangsmulkten ugyldig.<\/p>\n<p>En samlet H\u00f8yesterett kom \u2013 i motsetning til lagmannsretten \u2013 til at loven ikke krever at husbyggingen m\u00e5 gjennomf\u00f8res innen rimelig tid for at tillatelsen ikke skal falle bort. Et flertall p\u00e5 tre dommere mente lovhjemmelen krevet at det, for \u00e5 unng\u00e5 at arbeidet regnes som innstilt, er tilstrekkelig \u00e5 utf\u00f8re arbeid som i l\u00f8pet av en to\u00e5rsperiode gir et reelt bidrag til fremdrift og fullf\u00f8ring av tiltaket. Arbeid uten nevneverdig betydning m\u00e5 det ses bort fra. Husbyggeren oppfylte dette kravet, og tillatelsen var derfor ikke falt bort. P\u00e5legget om tilbakef\u00f8ring, og dermed ogs\u00e5 tvangsmulkten, var derfor ugyldig, og tvangsfullbyrdelsen ble stanset.<\/p>\n<p>Et mindretall p\u00e5 to dommere mente av loven stiller noe strengere krav til fremdrift, slik at det i l\u00f8pet av en to\u00e5rsperiode m\u00e5 utf\u00f8res arbeider som ikke er av uvesentlig omfang.
