Gulating lagmannsrett ga dem medhold i ekspropriasjon til veg etter vegloven \u00a7 53, og la vekt p\u00e5 hensynet til trygg og tjenlig atkomst til egen bolig. Eieren av naboeiendommen anket til\u00a0H\u00f8yesterett. Han anf\u00f8rte at ekspropriasjon kun kan skje hvis samfunnsinteresser taler for ekspropriasjon, og slike interesser var ikke p\u00e5vist, mente han.<\/p>\n<p>H\u00f8yesterett kom til at vilk\u00e5rene for inngrep etter vegloven \u00a7 53 var oppfylt. Bestemmelsen m\u00e5tte tolkes slik at ekspropriasjon kan skje dersom samfunnsinteressene som ligger bak vedtakelsen av vegloven \u00a7 53, privat behov for veg, taler for ekspropriasjon og veier tyngre enn ulempene for den som inngrepet retter seg mot.
