Kommunen foretok p\u00e5 2010-tallet en kartlegging av tiltak i strandsonen. Da det ikke forel\u00e5 byggemelding om oppf\u00f8ring av brygga, ga kommunen p\u00e5legg om riving. Dagens eier av eiendommen mente p\u00e5 sin side at brygga ikke var meldepliktig etter dagjeldende bygningslov.<\/p>\n<h3>Den gamle bygningsloven<\/h3>\n<p>Bygningsloven 1965 \u00a7 84 ga meldeplikt for visse tiltak. Bestemmelsen nevner en rekke st\u00f8rre tiltak, slik som kaianlegg, bruer og idrettsanlegg, samt \u00abandre varige konstruksjoner og anlegg\u00bb. Sp\u00f8rsm\u00e5let for H\u00f8yesterett var s\u00e6rlig om uttrykket \u00abandre varige konstruksjoner\u00bb skal leses for seg eller i lys av de eksemplene som er nevnt.<\/p>\n<h3>H\u00f8yesterett fant at brygga ikke var meldepliktig<\/h3>\n<p>H\u00f8yesterett kom til at uttrykket \u00abandre varige konstruksjoner og anlegg\u00bb m\u00e5 tolkes i lys av de eksemplene som er nevnt i lovteksten. St\u00f8rre brygger kunne v\u00e6re omfattet, men i utgangspunktet ikke brygger beregnet til privat bruk for den eiendommen den ga atkomst til, og som ikke avvek fra normal st\u00f8rrelse og karakter for slike brygger.<\/p>\n<p>Brygga i saken for H\u00f8yesterett var relativt stor. Samtidig hadde st\u00f8rrelsen sammenheng med grunnforholdene p\u00e5 stedet. Det forel\u00e5 ikke andre hensyn som med tyngde talte for at det forel\u00e5 meldeplikt.
