Parallelt med at saken om tvangsoppl\u00f8sning ble begj\u00e6rt hevet, krevde de to saks\u00f8kerne at sameiet skulle seksjoneres, alts\u00e5 deles opp i ulike bruksenheter. Tingretten og lagmannsretten mente at saks\u00f8kerne ikke kunne kreve at tvangssaken skulle avsluttes.<\/p>\n<p>H\u00f8yesterett kom til at saks\u00f8kerne kunne trekke tilbake begj\u00e6ringen om tvangsoppl\u00f8sning. Omkostningene som har p\u00e5l\u00f8pt i en sak som heves p\u00e5 grunn av dette, m\u00e5 i utgangspunktet dekkes av saks\u00f8kerne. Andre sameiere vil regul\u00e6rt kunne kreve \u00e5 tre inn i et p\u00e5begynt tvangssalg og med det hindre at tvangssalget stanses.<\/p>\n<p>Videre slo H\u00f8yesterett fast at krav om eierseksjonering etter eierseksjonsloven \u00a7 9, som et utgangspunkt g\u00e5r foran et konkurrerende krav om tvangsoppl\u00f8sning av sameiet.<\/p>\n<p>Tingrettens og lagmannsrettens avgj\u00f8relser ble opphevet.<\/p>\n<p>Avgj\u00f8relsen avklarer adgangen til \u00e5 trekke en sak om tvangsoppl\u00f8sning av sameier.
