B\u00e5ndleggelsen ble videref\u00f8rt i ny reguleringsplan i 2020, og kommunen innl\u00f8ste etter avtale tomten basert p\u00e5 ekspropriasjonsrettslige erstatningsregler.<\/p>\n<p>Eieren krevde erstatning etter det s\u00e5kalte parkprinsippet. Prinsippet g\u00e5r ut p\u00e5 at n\u00e5r det innenfor et utbyggingsomr\u00e5de settes av areal til veier, friareal og andre fellesfunksjoner, s\u00e5 erstattes slikt areal p\u00e5 linje med det arealet som bygges ut, basert p\u00e5 en utjevnet str\u00f8kspris.<\/p>\n<p>H\u00f8yesterett viste til at hensynet bak parkprinsippet \u2013 \u00e5 utjevne ulikhet som ellers ville oppst\u00e5 innenfor et utbyggingsomr\u00e5de \u2013 ikke slo til i denne aktuelle situasjonen. N\u00e5r en grunneier i forbindelse med en utbygging selger tomter i en privat transaksjon, blir b\u00e5de st\u00f8rrelsen og fordelingen av det samlede vederlaget for tomtearealene endelig fastlagt gjennom avtalene som inng\u00e5s.
