Eiendomsmegleren videreformidlet imidlertid ikke selgerens aksept til budgiveren og bindende avtale kom derfor ikke i stand. Etter at akseptfristen var utl\u00f8pt kom det inn et h\u00f8yere bud p\u00e5 leiligheten og budrunden fortsatte. Leiligheten ble til slutt solgt til kj\u00f8peren for 150 000 kroner mer enn det opprinnelige budet han hadde gitt, og som selgeren hadde akseptert.<\/p>\n<p>I motsetning til lagmannsretten kom H\u00f8yesterett til at eiendomsmegleren handlet erstatningsbetingende uaktsomt overfor budgiveren, fordi han ikke videreformidlet selgerens f\u00f8rste aksept.
