Kort tid f\u00f8r eiendommen ble lagt ut for salg, var en mann som bor i et av nabohusene, d\u00f8mt til fengsel for \u00e5 ha filmet sine egne sted\u00f8tre i dusjen og i andre situasjoner p\u00e5 badet. Han var ogs\u00e5 d\u00f8mt for befatning med materiale som fremstiller seksuelle overgrep mot barn.<\/p>\n<p>Dommen var kjent i nabolaget, men det ble ikke gitt opplysning om den i forbindelse med salget. Da kj\u00f8perne kort tid etter salget ble kjent med dommen, trakk de seg og hevet avtalen. Selgerne m\u00e5tte selge eiendommen p\u00e5 nytt og reiste sak for retten med krav om erstatning for det tapet de led blant annet ved \u00e5 selge til en lavere pris.<\/p>\n<p>H\u00f8yesterett kom, i likhet med tingretten og lagmannsretten, til at selgerne ikke hadde plikt til \u00e5 gi opplysninger om straffedommen. Kj\u00f8perne var dermed ikke berettiget til \u00e5 heve kj\u00f8pet, og erstatningskravet f\u00f8rte fram.<\/p>\n<p>H\u00f8yesterett la vekt p\u00e5 at opplysninger om at en person har beg\u00e5tt bestemte straffbare handlinger, er personopplysninger av sensitiv karakter. Selv om det er forst\u00e5elig at kj\u00f8perne reagerer negativt, kan man vanligvis ikke forvente \u00e5 f\u00e5 slike opplysninger om personer i nabolaget.
