Dette skyldtes at kommunen etter overtakelsen vedtok \u00e5 anlegge en turvei over eiendommen. Selgerne avslo kravene og fikk medhold i H\u00f8yesterett.<\/p>\n<p>H\u00f8yesterett tok utgangspunkt i den alminnelige regelen om at kj\u00f8peren overtar risikoen for eiendommen i det overtakelsen finner sted. P\u00e5 overtakelsestidspunktet var forslag om en turvei over eiendommen ikke sendt p\u00e5 h\u00f8ring eller vedtatt. Kj\u00f8perne m\u00e5tte selv b\u00e6re risikoen for et mulig senere vedtak om en turvei. At det var lagt til rette for turveien i en vedtatt reguleringsplan, hadde ikke betydning. Eiendommen var dermed ikke i vesentlig d\u00e5rligere stand enn de hadde grunn til \u00e5 regne med.<\/p>\n<p>Selgerne hadde ogs\u00e5 oppfylt sin opplysningsplikt. Da eiendommen ble solgt, var kommunens planprosess i en tidlig fase, og det var ikke mulig \u00e5 gi kj\u00f8perne mer informasjon om den mulige turveien enn det som gikk frem av salgsprospektet.
