Helsefagarbeideren hadde et konfliktfylt forhold til pasienten, og utvekslet sms-er med henne etter at lovbruddet ble oppdaget. Arbeidstakeren mente det ikke var grunnlag for oppsigelse, og brakte saken inn for domstolene.<\/p>\n<p>Helsetilsynet ila helsefagarbeideren en advarsel som f\u00f8lge av bruddet p\u00e5 \u00a7 21 a. Dette reiste sp\u00f8rsm\u00e5l om hvilken betydning et tilsynsvedtak har i en arbeidsrettslig vurdering av hvilke konsekvenser lovbruddet skal ha for arbeidsforholdet.<\/p>\n<p>H\u00f8yesterett kom til at oppsigelsen oppfylte kravene i arbeidsmilj\u00f8loven \u00a7 15-7 f\u00f8rste ledd. Bruddet p\u00e5 helsepersonelloven \u00a7 21 a var alvorlig fordi den som har behov for helsetjenester skal kunne gj\u00f8re det i trygg forvissning om at ikke andre enn dem som har et tjenstlig behov f\u00e5r tilgang til helseopplysningene om seg. Det er n\u00f8dvendig for \u00e5 sikre at pasientene gir fullstendige opplysninger om sin helsetilstand, og dermed kan f\u00e5 riktig medisinsk behandling. At det var en konfliktfylt relasjon mellom helsefagarbeideren og pasienten, og at det ble utvekslet sms-er mellom dem i etterkant av lovbruddet, gjorde pliktbruddet mer graverende. I sum forel\u00e5 det en legitim og tungtveiende grunn til oppsigelse, og en avveining av arbeidstakerens og arbeidsgiverens interesser ledet ikke til at oppsigelsen var uforholdsmessig.<\/p>\n<p>Om forholdet mellom tilsynsvedtaket og den arbeidsrettslige prosessen uttalte H\u00f8yesterett at arbeidsgiverens og Helsetilsynets oppf\u00f8lgning av brudd p\u00e5 helsepersonelloven skjer uavhengig av hverandre. Tilsynsvedtaket utgj\u00f8r ikke noen sentral premiss for den arbeidsrettslige vurderingen, og arbeidsgiveren har ikke plikt til \u00e5 avvente utfallet av en eventuell tilsynsprosess f\u00f8r man beslutter og iverksetter arbeidsrettslige reaksjoner. Et vedtak fra Helsetilsynet er likevel ikke uten relevans i vurderingen av om det er grunnlag for oppsigelse som f\u00f8lge av brudd p\u00e5 helsepersonelloven. Slike vedtak kan gi en viss veiledning om alvoret i pliktbruddet, bed\u00f8mt ut fra de hensyn tilsynsvirksomheten ivaretar.<\/p>\n<p>Dommen gir veiledning om n\u00e5r brudd p\u00e5 helsepersonelloven \u00a7 21 a kan gi grunnlag for oppsigelse, og om forholdet mellom Helsetilsynets vedtak og arbeidsgiverens vurdering av om lovbruddet skal f\u00e5 f\u00f8lger for arbeidsforholdet.<\/p>\n<p>Source:
