H\u00f8yesterett kom til at bestemmelsen om betalingsplikt var ugyldig p\u00e5 grunn av bristende forutsetninger, og at kontantbidraget m\u00e5tte betales tilbake. Kommunens anke ble forkastet.<\/p>\n<p>I en reguleringsplan var det stilt opp rekkef\u00f8lgekrav om gjennomf\u00f8ring av ulike veitiltak f\u00f8r utbygging kunne skje. Foretaket \u00f8nsket \u00e5 bygge p\u00e5 en eiendom i planomr\u00e5det og fikk dispensasjon fra rekkef\u00f8lgekravene mot \u00e5 inng\u00e5 utbyggingsavtale med kommunen. I avtalen p\u00e5tok foretaket seg \u00e5 betale en andel av kostnadene til veitiltakene, mens kommunen skulle s\u00f8rge for gjennomf\u00f8ring av dem. Kommunen bestemte seg for \u00e5 la kontantbidraget g\u00e5 inn som en del av kommunens bidrag p\u00e5 158 millioner kroner til en omfattende infrastrukturpakke \u2013 F\u00f8rdepakken. Veitiltakene ble utf\u00f8rt som en del av F\u00f8rdepakken og sto ferdige i 2020.<\/p>\n<p>H\u00f8yesteretts flertall p\u00e5 fire dommere la til grunn at bestemmelsen om betaling av kontantbidrag var ugyldig p\u00e5 grunn av bristende forutsetninger, og at kommunen m\u00e5tte betale tilbake bel\u00f8pet.
