Etter denne bestemmelsen m\u00e5 en oppsigelse i pr\u00f8vetiden v\u00e6re begrunnet i arbeidstakerens manglende tilpasning til arbeidet, faglige dyktighet eller p\u00e5litelighet.<\/p>\n<p>Det kan ikke stilles idealkrav til arbeidstakerens utf\u00f8relse av arbeidet i pr\u00f8vetiden, men det kan kreves at arbeidsytelsen ligger p\u00e5 et gjennomsnittlig niv\u00e5, samtidig som arbeidsgiver m\u00e5 ta hensyn til den pr\u00f8vetidsansattes manglende arbeidserfaring. Arbeidsgiver kan imidlertid stille store krav til punktlighet, samt at arbeidsoppgaver som tildeles l\u00f8pende blir utf\u00f8rt i henhold til instrukser.<\/p>\n<p>Dersom oppsigelsen av den pr\u00f8vetidsansatte skyldes andre forhold enn manglende tilpasning til arbeidet, faglige dyktighet eller p\u00e5litelighet, kommer det alminnelige saklighetskravet i arbeidsmilj\u00f8loven \u00a7 15-7 til anvendelse. Dette gjelder for eksempel dersom arbeidsgiver m\u00e5 gjennomf\u00f8re nedbemanning.<\/p>\n<h2>Den ansatte m\u00e5 ha f\u00e5tt tilstrekkelig oppf\u00f8lgning og oppl\u00e6ring<\/h2>\n<p>Et sentralt moment i vurderingen av om oppsigelsen av en pr\u00f8vetidsansatt er saklig, er om den ansatte har f\u00e5tt tilstrekkelig oppl\u00e6ring og oppf\u00f8lgning.<\/p>\n<p>Kravet til omfanget av oppl\u00e6ring avhenger av hva slags stilling det er snakk om, og hvilken erfaring arbeidstakeren har. Dersom arbeidsgiver ikke kan dokumentere at det er gitt tilbakemelding og veiledning, vil dette kunne medf\u00f8re at oppsigelsen kjennes ugyldig.<\/p>\n<p>Et godt r\u00e5d til arbeidsgivere som merker at arbeidstaker ikke mestrer rollen eller arbeidsoppgavene, er dermed \u00e5 gi l\u00f8pende skriftlige tilbakemeldinger til den pr\u00f8vetidsansatte, eller gjennomf\u00f8re oppf\u00f8lgingsm\u00f8ter som det lages referater fra.<\/p>\n<h2>Arbeidsgiver m\u00e5 f\u00f8lge saksbehandlingsreglene i arbeidsmilj\u00f8loven<\/h2>\n<p>For det tilfelle at arbeidsgiver vil g\u00e5 til oppsigelse av den pr\u00f8vetidsansatte, m\u00e5 arbeidsmilj\u00f8lovens saksbehandlingsregler f\u00f8lges.
