Oppsigelsen var begrunnet med manglende p\u00e5litelighet som f\u00f8lge av at mannen hadde gitt villedende opplysninger da han s\u00f8kte stillingen.<\/p>\n<p>Mannen fikk jobb som servit\u00f8r ved en bedre restaurant i Oslo, uten \u00e5 opplyse at han rett forut for dette hadde blitt avskjediget ved en annen, lignende restaurant p\u00e5 grunn av samarbeidsproblemer og beskyldninger om trusler mv. Denne avskjedigelsen ble senere kjent ugyldig i rettskraftig dom fra Oslo tingrett.<\/p>\n<p>H\u00f8yesterett tok utgangspunkt i at en arbeidss\u00f8ker ikke kan gi direkte villedende informasjon om seg selv og tidligere arbeidsforhold. Samtidig vil arbeidss\u00f8ker ha rett til prim\u00e6rt \u00e5 trekke fram det som taler til sin fordel. En eventuell opplysningsplikt vil f\u00f8rst og fremst avhenge av om informasjonen gjelder sp\u00f8rsm\u00e5l om faglige kvalifikasjoner og arbeidserfaring av direkte betydning for arbeidss\u00f8kers egnethet for arbeidet.<\/p>\n<p>Dersom arbeidss\u00f8ker har holdt tilbake opplysninger som han m\u00e5tte forst\u00e5 var vesentlige for arbeidsgiver, og tilbakeholdelsen etter en helhetsvurdering m\u00e5 anses klart illojal fra arbeidss\u00f8kers side, kan det etter H\u00f8yesteretts syn lede til oppsigelse p\u00e5 grunn av manglende p\u00e5litelighet.
