Dette f\u00f8lger av arbeidsmilj\u00f8loven \u00a7 15-4.<\/p>\n<p>Oppsigelsen skal leveres til arbeidstaker personlig eller sendes i rekommandert brev til arbeidstakers oppgitte adresse og inneholde opplysninger om:<\/p>\n<p>a) arbeidstakers rett til \u00e5 kreve forhandling og reise s\u00f8ksm\u00e5l,<br \/>\nb) retten til \u00e5 fortsette i stillingen etter bestemmelsene i arbeidsmilj\u00f8loven \u00a7\u00a7\u00a017-3,\u00a017-4\u00a0og\u00a015-11,<br \/>\nc) de frister som gjelder for \u00e5 kreve forhandling, reise s\u00f8ksm\u00e5l og for \u00e5 fortsette i stillingen, og<br \/>\nd) hvem som er arbeidsgiver og rett saks\u00f8kt i en eventuell tvist.<\/p>\n<p>Er oppsigelsen begrunnet i virksomhetens forhold, skal den ogs\u00e5 inneholde opplysninger om fortrinnsrett etter\u00a0loven \u00a7 14-2.<\/p>\n<h2>Plikt til \u00e5 oppgi begrunnelse dersom den ansatte ber om det<\/h2>\n<p>Dersom arbeidstaker krever det, plikter arbeidsgiver \u00e5 oppgi de omstendigheter som p\u00e5beropes som grunn for oppsigelsen. Det er s\u00e5ledes ikke et krav at arbeidsgiver oppgir begrunnelsen for oppsigelsen av eget tiltak. Arbeidstaker kan kreve \u00e5 f\u00e5 begrunnelsen skriftlig.<\/p>\n<h2>Begrunnelsen vil bli tillagt betydning som bevis<\/h2>\n<p>Dersom arbeidsgiver gir en skriftlig begrunnelse for oppsigelsen, vil begrunnelsen bli tillagt betydning som bevis i en eventuell senere rettssak. Det vil da v\u00e6re den oppgitte begrunnelsen som blir pr\u00f8vd i relasjon til <a href=\"https:\/\/melo.no\/en\/juridisk-innsikt\/arbeidsrett\/arbeidsmiljolovens-vern-mot-usaklig-oppsigelse\/\">oppsigelsesvernet i arbeidsmilj\u00f8loven\u00a0\u00a7 15-7<\/a>. Dersom begrunnelse ikke oppgis, blir det gjerne oppfattet som en sterk indikasjon p\u00e5 at arbeidsgiver ikke har hatt tilstrekkelig saklig grunn for oppsigelsen, og manglende begrunnelse vil dessuten kunne f\u00e5 betydning for saksomkostningssp\u00f8rsm\u00e5let.<\/p>\n<h2>Virkninger av formfeil ved oppsigelse<\/h2>\n<p>Dersom arbeidsgivers oppsigelse ikke er gitt skriftlig eller ikke inneholder opplysninger som nevnt i loven\u00a0\u00a7 15-4\u00a0og arbeidstaker g\u00e5r til s\u00f8ksm\u00e5l innen 4 m\u00e5neder etter at oppsigelsen fant sted, er lovens system at oppsigelsen skal kjennes ugyldig, med mindre s\u00e6rlige omstendigheter gj\u00f8r dette \u00e5penbart urimelig.<\/p>\n<h2>Arbeidstaker vil kunne kreve erstatning<\/h2>\n<p>Er oppsigelsen ugyldig, kan arbeidstaker dessuten kreve erstatning. Det samme gjelder dersom oppsigelsen er mangelfull, men arbeidstaker ikke krever dom for ugyldighet eller det ikke blir avsagt dom for ugyldighet fordi s\u00e6rlige omstendigheter gj\u00f8r dette \u00e5penbart urimelig.
