Dette f\u00f8lger av arbeidsmilj\u00f8loven \u00a7 15-1. B\u00e5de grunnlaget for oppsigelsen og eventuell utvelgelse mellom flere ansatte av hvem som skal sies opp, skal dr\u00f8ftes.<\/p>\n<h2>Sp\u00f8rsm\u00e5let om oppsigelse m\u00e5 dr\u00f8ftes med arbeidstaker\u00a0<em>f\u00f8r<\/em> beslutning treffes<\/h2>\n<p>Bestemmelsen gjelder plikten til \u00e5 dr\u00f8fte oppsigelse med arbeidstaker f\u00f8r beslutning treffes. Form\u00e5let med dr\u00f8ftingene er at arbeidsgiver skal kunne foreta de n\u00f8dvendige vurderinger i relasjon til <a href=\"https:\/\/melo.no\/en\/juridisk-innsikt\/arbeidsrett\/arbeidsmiljolovens-vern-mot-usaklig-oppsigelse\/\">saklighetskravet<\/a>. I lovforarbeidene er det fremhevet at arbeidsgiver ved <a href=\"https:\/\/melo.no\/en\/juridisk-innsikt\/arbeidsrett\/rasjonalisering-eller-driftsinnskrenkning-etter-arbeidsmiljoloven-\u00a7-15-7\/\">oppsigelse p\u00e5 grunn av virksomhetens forhold<\/a> har plikt til \u00e5 vurdere omplassering og \u00e5 foreta en interesseavveining mellom virksomhetens behov og arbeidstakers ulemper. Disse vurderingene kan vanskelig foretas uten i samarbeid med arbeidstakeren. Det er videre understreket at ved <a href=\"https:\/\/melo.no\/en\/juridisk-innsikt\/arbeidsrett\/arbeidsmiljolovens-vern-mot-usaklig-oppsigelse\/\">oppsigelse p\u00e5 grunn av arbeidstakers forhold<\/a> er forutg\u00e5ende dr\u00f8ftelse selvsagt. I nyere rettspraksis er det \u00f8kt fokus p\u00e5 mangelfull saksbehandling, herunder mangel p\u00e5 dr\u00f8ftelser.<\/p>\n<h2>Den store hovedregelen er at dr\u00f8ftelser skal gjennomf\u00f8res<\/h2>\n<p>Dr\u00f8ftelser skal gjennomf\u00f8res \u00abs\u00e5 langt det er praktisk mulig\u00bb med mindre arbeidstaker ikke selv \u00f8nsker det. Det er lagt opp til at det ikke skal v\u00e6re kurant for arbeidsgiver \u00e5 p\u00e5berope praktiske vanskeligheter, og den store hovedregel er at dr\u00f8ftelser skal gjennomf\u00f8res.<\/p>\n<h2>Ingen bestemte formkrav, men alminnelige prinsipper om kontradiksjon b\u00f8r f\u00f8lges<\/h2>\n<p>Det gjelder ikke formkrav til innkalling og gjennomf\u00f8ring av dr\u00f8ftelser, men arbeidstaker b\u00f8r varsles om hva som skal dr\u00f8ftes p\u00e5 m\u00f8tet og innkalles i god tid, slik at han eller hun f\u00e5r anledning til \u00e5 forberede seg. Det vil normalt v\u00e6re en fordel at innkallingen gj\u00f8res skriftlig, bl.a. av bevishensyn.<\/p>\n<h2>Den ansatte b\u00f8r f\u00e5 lov til \u00e5 ta med seg noen i m\u00f8tet<\/h2>\n<p>Slik loven er formulert har arbeidstaker anledning til \u00e5 ha med seg tillitsvalgt. Arbeidstaker b\u00f8r normalt ogs\u00e5 gis anledning til \u00e5 m\u00f8te med r\u00e5dgiver etter eget valg, f.eks. en advokat.<\/p>\n<h2>Gjennomf\u00f8r dr\u00f8ftingsm\u00f8te &#8211; alltid<\/h2>\n<p>Dr\u00f8ftingsregelen er i lovforarbeidene\u00a0karakterisert som en ordensforskrift, slik at unnlatelse av \u00e5 dr\u00f8fte ikke n\u00f8dvendigvis medf\u00f8rer at oppsigelsen er ugyldig. Det er en saksbehandlingsfeil som vil v\u00e6re ett av flere momenter ved vurderingen av om en oppsigelse er saklig. Betydningen vurderes konkret i hvert enkelt tilfelle. Unnlatelse av \u00e5 gjennomf\u00f8re dr\u00f8ftingsm\u00f8te kan ogs\u00e5 f\u00e5 betydning for st\u00f8rrelsen p\u00e5 en eventuell erstatning.\u00a0Vi anbefaler s\u00e5ledes at arbeidsgiver alltid gjennomf\u00f8rer dr\u00f8ftingsm\u00f8te med den ansatte f\u00f8r det tas stilling til sp\u00f8rsm\u00e5l om oppsigelse, med mindre den ansatte selv ikke \u00f8nsker det.<\/p>\n\t<\/div>\r\n<\/div>\r\n\r\n\r\n\r\n\n\t\t<\/div> \n\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n\n\t<div  class=\"vc_col-sm-4 wpb_column column_container vc_column_container col no-extra-padding\"  data-t-w-inherits=\"default\" data-border-radius=\"none\" data-shadow=\"none\" data-border-animation=\"\" data-border-animation-delay=\"\" data-border-width=\"none\" data-border-style=\"solid\" data-border-color=\"\" data-bg-cover=\"\" data-padding-pos=\"all\" data-has-bg-color=\"false\" data-bg-color=\"\" data-bg-opacity=\"1\" data-hover-bg=\"\" data-hover-bg-opacity=\"1\" data-animation=\"\" data-delay=\"0\" ><div class=\"column-bg-overlay\"><\/div>\n\t\t<div class=\"vc_column-inner\">\n\t\t\t<div class=\"wpb_wrapper\">\n\t\t\t\t<div id=\"fws_6a1af38c37146\" data-midnight=\"\" data-column-margin=\"default\" data-bg-mobile-hidden=\"\" class=\"wpb_row vc_row-fluid vc_row inner_row standard_section\"  style=\"padding-top: 0px;
