Hvis du ikke reklamerer innen fristen, tapes retten til \u00e5 gj\u00f8re krav som f\u00f8lge av mangelen gjeldende. Hva som er rimelig tid varierer, men i rettspraksis er det lagt til grunn at man skal ha gode grunner for \u00e5 vente noe mer enn to m\u00e5neder med \u00e5 fremme en reklamasjon. R\u00e5det er derfor enkelt; reklam\u00e9r straks du mistenker at noe er galt.<\/p>\n<h2>En reklamasjon m\u00e5 v\u00e6re noe mer enn en generell klage<\/h2>\n<p>En reklamasjon m\u00e5 v\u00e6re noe mer enn en generell klage over boligen. For at en reklamasjon skal v\u00e6re gyldig, og ha fristavbrytende virkning, stilles det krav til innholdet i meldingen til selger:<\/p>\n<ul>\n<li>Av meldingen m\u00e5 det fremkomme at man mener at det foreligger avtalebrudd (mangel).<\/li>\n<li>Det m\u00e5 gis n\u00e6rmere opplysninger om hva slags mangel som foreligger.<\/li>\n<li>Det m\u00e5 fremg\u00e5 av kj\u00f8per vil p\u00e5berope seg avtalebruddet og fremsette et rettslig krav.<\/li>\n<\/ul>\n<p>I en del tilfeller har ikke kj\u00f8per tilstrekkelig grunnlag for \u00e5 spesifisere mangelen eller det krav som er aktuelt \u00e5 fremme. Kj\u00f8per har for eksempel oppdaget fukt i kjelleren, men har ikke oversikt over omfanget og \u00e5rsaken til fukten. I slik tilfeller er det tilstrekkelig at kj\u00f8per i f\u00f8rste melding varsler at det er oppdaget en mangel som selger er ansvarlig for, hvilke forhold som utgj\u00f8r mangelen og at det vil bli fremsatt et krav.<\/p>\n<h2>Som hovedregel ingen formkrav<\/h2>\n<p>Som utgangspunkt gjelder det ingen bestemte formkrav til reklamasjonen. Reklamasjonen kan s\u00e5ledes fremsettes b\u00e5de muntlig og skriftlig. Av bevismessige hensyn b\u00f8r imidlertid reklamasjonen v\u00e6re skriftlig.<\/p>\n<h2>Lurt \u00e5 engasjere fagkyndig<\/h2>\n<p>Videre b\u00f8r du engasjere en fagkyndig til \u00e5 foreta en vurdering av manglene. Dette b\u00f8r gj\u00f8res s\u00e5 snart som mulig etter at f\u00f8rste melding er sendt til selger. Flere takseringsfirma tilbyr s\u00e5kalte reklamasjonsrapporter. En reklamasjonsrapport er i prinsippet en tilstandsrapport der mandatet er \u00e5 foreta en vurdering av reklamerte forhold ved boligen opp mot boligopplysningene som ble gitt ved salget. Det gis ogs\u00e5 ofte et kostnadsoverslag for eventuelle utbedringskostnader.<\/p>\n<p>N\u00e5r du har mottatt reklamasjonsrapporten, er det viktig \u00e5 f\u00f8lge opp reklamasjonen overfor selger. Manglene som er gjort gjeldende m\u00e5 spesifiseres, og rapporten i sin helhet b\u00f8r fremlegges for selger. Kravet mot selger m\u00e5 dernest ogs\u00e5 spesifiseres, herunder om det kreves retting, prisavslag, heving eller erstatning.<\/p>\n<h2>Hvis selger avviser kravet eller ikke besvarer det<\/h2>\n<p>Hvis selger avviser kravet eller ikke besvarer det, b\u00f8r det vurderes om det skal tas rettslige skritt. Selv om det er reklamert over mangelen i tide, kan kravet g\u00e5 tapt etter reglene om foreldelse. Kravet mot selger foreldes som hovedregel tre \u00e5r etter overtagelsen, eventuelt ett \u00e5r etter at kj\u00f8peren fikk kunnskap om mangelen, dersom dette tidspunkt inntrer senere. For \u00e5 avbryte foreldelse m\u00e5 det som hovedregel tas rettslige skritt, dersom ikke selger erkjenner kravet.<\/p>\n<h2>Selger m\u00e5 f\u00e5 en sjanse<\/h2>\n<p>Endelig er verdt \u00e5 merke seg at reklamasjonsreglene virker slik at man ikke m\u00e5 utbedre mangelen selv f\u00f8r man fremmer reklamasjon til selger.
