Forslaget vi n\u00e5 sender p\u00e5 h\u00f8ring vil redusere statens adgang til \u00e5 overpr\u00f8ve kommunens skj\u00f8nnsut\u00f8velse i lokalpolitiske saker, sier Nikolai Astrup, kommunal- og moderniseringsminister.<\/p>\n<\/div>\n<div class=\"article-body\">\n<p>Kommunal- og moderniseringsdepartementet sender n\u00e5 ut forslag til endring av plan- og bygningslovens bestemmelse om dispensasjon p\u00e5 h\u00f8ring.<\/p>\n<p>Dagens dispensasjonsregler stiller strenge vilk\u00e5r for dispensasjon, og fylkesmannen kan overpr\u00f8ve kommunens vurderinger i alle typer dispensasjonssaker \u2013 ogs\u00e5 i saker hvor det bare er lokale hensyn som ivaretas.<\/p>\n<p>Terskelen for \u00e5 innvilge dispensasjon blir senket, og fylkesmannens adgang til \u00e5 overpr\u00f8ve kommunens skj\u00f8nn blir mer begrenset enn i dag. Det skal ikke v\u00e6re adgang til \u00e5 gi dispensasjon dersom nasjonale eller regionale interesser blir vesentlig tilsidesatt.<\/p>\n<p>\u2013 Vi har f\u00e5tt mange innspill om at dispensasjonsregelverket er krevende, og mener det er riktig \u00e5 gi kommunene st\u00f8rre handlingsrom. Det er kommunene som best kjenne situasjonen lokalt, sier Astrup.<\/p>\n<h3>Her er noen av forslagene som sendes p\u00e5 h\u00f8ring:<\/h3>\n<ul>\n<li>I dag kan kommunene gi dispensasjon fra plan- og bygningsloven n\u00e5r fordelene er klart st\u00f8rre enn ulempene. I h\u00f8ringsforslaget er ordet &laquo;klart&raquo; fjernet, som betyr at det kan gis dispensasjon n\u00e5r fordelene ogs\u00e5 bare er litt st\u00f8rre enn ulempene.<\/li>\n<li>Det blir strengere krav til hva fylkesmannen kan overpr\u00f8ve. Fylkesmannen kan fullt ut overpr\u00f8ve vurderingen av regionale og nasjonale interesser, men m\u00e5 legge stor vekt p\u00e5 kommunens vurdering av sp\u00f8rsm\u00e5let om fordelene ved dispensasjon er st\u00f8rre enn ulempene.<\/li>\n<li>Fylkesmannen skal fortsatt kunne overpr\u00f8ve dispensasjonssaker i strandsonen, saker som ber\u00f8rer jordvern, kulturminner eller samiske interesser.
